Highway Debris Responsibility

Just your average everyday normal highway-driving dump truck. But this one has a special exemption!

I think that seems fair.

After all, this truck cannot be held responsible for all objects that fly up from the road from anywhere to hit cars. Unless, perhaps, this truck was the one that pulled the object from the road up into the car, in which case, it may not be responsible, but it certainly helped cause the issue.

I wonder about the legal back story of this sign. Could it possibly be used in court to show that other drivers had been sufficiently warned?

Do you notice the super small text as well? Other drivers may not get hit by debris, but they will definitely have to tailgate and possibly rear-end the truck while they read the sign.

  1. This sign has the legal weight of a software EULA. Which is effectively none at all. You cannot make yourself free from fault simply by warning people. Why not wear a shirt that says “Not responsible if you randomly get stabbed” and then going around all stabby at people with a knife.

  2. As a rule, we don’t sue vehicles for negligent behavior or practices. We sue the driver, the owner of the vehicle (either an individual or a company), those with responsibility for the maintenance of the vehicle and other people or companies involved with the shipping, loading or handling of the content in the vehicle.

    So, in a sense, the sign is right. The truck itself would not be liable for the objects coming from the road.
